Commission on CLE proposes amendments to the Bankruptcy and Debtor-Creditor Law and Taxation Law Standards and Procedures At its recent meeting, the S.C. Supreme Court Commission on CLE and Specialization approved the specialization advisory boards’ amendments to the Standards and Procedures for Certification, Recertification and Decertification for bankruptcy and debtor-credi- tor law and taxation law. The Bankruptcy and Debtor-Creditor Law Specialization Advisory Board proposed to amend the continuing legal education (CLE) requirement for certification and recertifica- tion by allowing a portion of the required credits to be obtained in trial advocacy courses. Currently, specialists and candidates for specialization must obtain all of the required hours exclusively through bankruptcy and debtor-creditor law specialization hours. The Taxation Law Specialization Advisory Board proposed to amend its CLE requirement for recertification. Currently, to qualify for recertification applicants must earn a total of 150 hours of approved specialty credit in the five years since their original or latest certification. The proposed amendment reduces the CLE requirement to provide that 120 hours of approved specialty credit would be required for recertification. To become effective, all proposed amendments must be filed with and approved by the Supreme Court. The Commission requests that the amendments become effective immediately upon receipt of such approval. As amended, subparagraph II (C) and subparagraph IV (C) of the Bankruptcy and Debtor-Creditor Law Specialization Advisory Board Standards and Procedures for Certification, Recertification and Decertification would provide: II.
